{"id":12306,"date":"2013-12-09T09:20:43","date_gmt":"2013-12-09T08:20:43","guid":{"rendered":"https:\/\/www.toutsurmesfinances.com\/immobilier\/le-refus-de-pret-immobilier-pas-forcement-suspensif-de-la-promesse-de-vente.html"},"modified":"2021-12-02T11:18:35","modified_gmt":"2021-12-02T10:18:35","slug":"le-refus-de-pret-immobilier-pas-forcement-suspensif-de-la-promesse-de-vente","status":"publish","type":"post","link":"https:\/\/www.toutsurmesfinances.com\/immobilier\/le-refus-de-pret-immobilier-pas-forcement-suspensif-de-la-promesse-de-vente.html","title":{"rendered":"Le refus de pr\u00eat immobilier pas forc\u00e9ment suspensif de la promesse de vente"},"content":{"rendered":"<section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-12 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><p>En mati\u00e8re d&rsquo;achat immobilier, la r\u00e9daction de la promesse de vente demande un soin tout particulier. <a href=\"http:\/\/www.dalloz-actualite.fr\/sites\/dalloz-actualite.fr\/files\/resources\/2013\/12\/12-29.021.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Un arr\u00eat de la Cour de Cassation rendu le 20 novembre 2013<\/a> est venu rappeler cette \u00e9vidence aux acheteurs et vendeurs.<\/p>\n<p>L&rsquo;affaire trait\u00e9e est relativement simple : l&rsquo;acheteur et le vendeur signent un compromis de vente \u00ab <em>sous condition suspensive de l&rsquo;obtention d&rsquo;un pr\u00eat au taux maximum de 4,75%<\/em> \u00bb. L&rsquo;acheteur, cherchant \u00e0 souscrire un cr\u00e9dit immobilier dans de meilleures conditions, se voit refuser sa demande de pr\u00eat \u00e0 4,20% par la banque BNP Paribas. D\u00e8s lors, il demande \u00e0 faire jouer la condition suspensive de la promesse de vente afin de se lib\u00e9rer de l&rsquo;achat immobilier. Pour rappel, il est l\u00e9galement possible d&rsquo;annuler une vente immobili\u00e8re lorsque l&rsquo;acqu\u00e9reur ne parvient pas \u00e0 obtenir un pr\u00eat pour financer son achat : le d\u00e9lai l\u00e9gal minimum pour obtenir un cr\u00e9dit immobilier est fix\u00e9 \u00e0 un mois apr\u00e8s la signature du compromis de vente.<\/p>\n<p>Dans cette affaire, le vendeur d\u00e9nonce alors une instrumentalisation des conditions suspensives de vente. Il reproche \u00e0 l&rsquo;acheteur d&rsquo;avoir demand\u00e9 \u00e0 obtenir un taux de cr\u00e9dit inf\u00e9rieur \u00e0 celui inscrit dans la promesse de vente, contrevenant ainsi aux conditions fix\u00e9es dans le compromis.<\/p>\n<p>La cour d&rsquo;appel de Versailles avait donn\u00e9 raison \u00e0 l&rsquo;acheteur dans un arr\u00eat du 27 septembre 2012. Selon elle, le seul fait de chercher \u00e0 obtenir un meilleur taux de cr\u00e9dit immobilier ne constituait pas un manquement de la part de l&rsquo;acheteur et ne pouvait d\u00e8s lors par entra\u00eener la mise en jeu de la clause p\u00e9nale. Cette derni\u00e8re pr\u00e9voit une p\u00e9nalit\u00e9 pour l&rsquo;acheteur ou le vendeur qui se r\u00e9tracte dans des conditions non pr\u00e9vues dans le compromis de vente. La p\u00e9nalit\u00e9 s&rsquo;\u00e9l\u00e8ve en g\u00e9n\u00e9ral \u00e0 10% du prix de vente.<\/p>\n<p>Mais la Cour de Cassation a pris le parti inverse, estimant que l&rsquo;acheteur n&rsquo;avait pas rempli son obligation de rechercher un financement en phase avec les conditions inscrites dans la promesse de vente. La Cour a donc cass\u00e9 le jugement et renvoy\u00e9 l&rsquo;affaire devant la Cour d&rsquo;appel de Versailles. De quoi rappeler, s&rsquo;il en \u00e9tait besoin, l&rsquo;importance toute particuli\u00e8re que demande la r\u00e9daction d&rsquo;un compromis de
