Et m\u00eame beaucoup plus : <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/projet-de-loi-alur-ce-qui-va-changer-pour-les-locataires-et-proprietaires.html#copropriete-syndic-tarification\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>la loi Alur sur le logement et l&rsquo;urbanisme<\/strong><\/a> instaure une multitude de documents annexes \u00e0 transmettre obligatoirement aux n\u00e9o-copropri\u00e9taires avant qu&rsquo;ils ne rentrent dans les lieux.<\/p>\n<p>Avant m\u00eame d&rsquo;entreprendre les d\u00e9marches concr\u00e8tes d&rsquo;acquisition, les particuliers doivent \u00eatre davantage inform\u00e9s dans les annonces de ventes. Celles-ci devront stipuler explicitement que le logement mis sur le march\u00e9 fait partie d&rsquo;une copropri\u00e9t\u00e9, le nombre de lots et de copropri\u00e9taires ainsi que le montant des charges courantes annuelles.<\/p>\n<p>L&rsquo;ensemble des documents suivants doivent \u00eatre \u00ab <em>annex\u00e9s \u00e0 la promesse de vente ou, \u00e0 d\u00e9faut de promesse, \u00e0 l&rsquo;acte authentique de vente<\/em> \u00bb, pr\u00e9cise la loi.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Les_pieces_a_transmettre_des_maintenant\"><\/span>Les pi\u00e8ces \u00e0 transmettre d\u00e8s maintenant<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Un certain nombre de documents doivent \u00eatre transmis par les vendeurs aux futurs copropri\u00e9taires depuis l&rsquo;entr\u00e9e en vigueur de la loi Alur apr\u00e8s sa publication au Journal officiel le 26 mars 2014. Par exemple, le r\u00e8glement de la copropri\u00e9t\u00e9 doit \u00eatre joint en annexe de l&rsquo;avant-contrat, de m\u00eame que la description de la copropri\u00e9t\u00e9 (nombre de lots et de copropri\u00e9taires).<\/p>\n<p>A cela s&rsquo;ajoutent les proc\u00e8s-verbaux des assembl\u00e9es g\u00e9n\u00e9rales des trois derni\u00e8res ann\u00e9es, \u00ab si le copropri\u00e9taire vendeur en dispose \u00bb, indique toutefois la loi Alur. Enfin, le montant des charges courantes inscrites dans le budget pr\u00e9visionnel, support\u00e9es par le vendeur lors des deux derni\u00e8res ann\u00e9es pleines, doit \u00eatre signal\u00e9 \u00e0 l&rsquo;acheteur. Il en va de m\u00eame pour les charges non inscrites dans le budget pr\u00e9visionnel.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Les_documents_a_exiger_du_syndic\"><\/span>Les documents \u00e0 exiger du syndic<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Les syndics de copropri\u00e9t\u00e9 sont charg\u00e9s de d\u00e9livrer plusieurs documents annexes indispensables \u00e0 la r\u00e9alisation de la vente d&rsquo;un lot. Un \u00e9tat global des impay\u00e9s de charges au sein du syndicat et des dettes contract\u00e9es aupr\u00e8s de fournisseurs doit ainsi \u00eatre pr\u00e9sent\u00e9 \u00e0 l&rsquo;acqu\u00e9reur. M\u00eame chose pour le carnet d&rsquo;entretien de la copropri\u00e9t\u00e9. Enfin, les sommes \u00ab <em>pouvant rester dues par le copropri\u00e9taire vendeur au syndicat des copropri\u00e9taires et les sommes qui seront dues au syndicat par l&rsquo;acqu\u00e9reur<\/em> \u00bb doivent \u00eatre pr\u00e9cis\u00e9es.<\/p>\n<p><em><strong>A savoir :<\/strong><\/em> La loi Alur permet quelques d\u00e9rogations en mati\u00e8re de documents obligatoires, si l&rsquo;acheteur reconna\u00eet que le notaire ou le vendeur lui a remis le r\u00e8glement de la copropri\u00e9t\u00e9, le carnet d&rsquo;entretien et la description du nombre de lots et de copropri\u00e9taires.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"De_nombreuses_annexes_a_ajouter_a_lavenir\"><\/span>De nombreuses annexes \u00e0 ajouter \u00e0 l&rsquo;avenir<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La liste des nouveaux documents \u00e0 pr\u00e9senter aux acheteurs ne s&rsquo;arr\u00eate pas l\u00e0. D&rsquo;autres pi\u00e8ces vont devoir \u00eatre int\u00e9gr\u00e9es aux avant-contrats, une fois que les d\u00e9crets d&rsquo;application n\u00e9cessaires auront \u00e9t\u00e9 publi\u00e9s au Journal officiel. C&rsquo;est notamment le cas de la mention explicite de la surface habitable du logement, en plus de la surface loi Carrez ou surface privative et de la notice d&rsquo;information sur les droits et obligations des copropri\u00e9taires et le fonctionnement du syndicat de copropri\u00e9taires.<\/p>\n<p><em><strong>A partir du 1er janvier 2017 :<\/strong><\/em> La fiche synth\u00e9tique de la copropri\u00e9t\u00e9, sorte de bilan de sant\u00e9 de la copropri\u00e9t\u00e9, devra \u00eatre transmise par les syndics, en sachant que son contenu doit \u00e9galement \u00eatre d\u00e9fini par d\u00e9cret. De plus, le montant des cotisations obligatoires pour les futurs fonds de travaux, \u00e9gales \u00e0 au moins 5% du budget pr\u00e9visionnel, devra \u00eatre pr\u00e9sent\u00e9 aux acqu\u00e9reurs, ainsi que les futurs diagnostics techniques globaux et plans pluriannuels de travaux.<\/p>\n<p>&nbsp;<\/p>\n<table style=\"background-color: #e0e0dd; width: 100%; border: #b0b0b0 thin solid;\" border=\"0\" cellpadding=\"5\">\n<tbody>\n<tr>\n<td>\n<h2 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"Ce_qui_change_pour_les_delais_de_retractation\"><\/span>Ce qui change pour les d\u00e9lais de r\u00e9tractation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Si les dossiers de vente ne sont pas complets, les futurs acqu\u00e9reurs auront davantage de temps pour se r\u00e9tracter.
