Mais si le vendeur d\u00e9m\u00e9nage avant de c\u00e9der son ancien logement, il doit imp\u00e9rativement vendre dans un d\u00e9lai \u00ab normal \u00bb, selon l&rsquo;administration fiscale, pour \u00e9chapper \u00e0 l&rsquo;imposition de la plus-value.<\/p>\n<p>Jusqu&rsquo;ici, le d\u00e9lai jug\u00e9 normal de vente se limitait \u00e0 un an. Mais le Conseil d&rsquo;Etat a chang\u00e9 cette donne dans une d\u00e9cision dat\u00e9e du 7 mai 2014. Dans l&rsquo;affaire tranch\u00e9e, la plus haute juridiction administrative de France a valid\u00e9 le b\u00e9n\u00e9fice de l&rsquo;exon\u00e9ration fiscale pour une vente intervenue 22 mois apr\u00e8s le d\u00e9m\u00e9nagement. Une d\u00e9cision qui pourrait faire jurisprudence \u00e0 l&rsquo;avenir pour d&rsquo;\u00e9ventuels contentieux entre les vendeurs et l&rsquo;administration fiscale. L&rsquo;appr\u00e9ciation du d\u00e9lai \u00ab normal \u00bb de vente continue cependant de relever de l&rsquo;administration fiscale.<\/p>\n<h2>Des conditions \u00e0 respecter<\/h2>\n<p>Pour continuer \u00e0 b\u00e9n\u00e9ficier de cette cl\u00e9mence fiscale, le vendeur doit cependant respecter certains crit\u00e8res d&rsquo;appr\u00e9ciation. Le logement doit ainsi constituer sa r\u00e9sidence principale jusqu&rsquo;\u00e0 la date de mise sur le march\u00e9. Selon le Conseil d&rsquo;Etat, le vendeur doit accomplir les \u00ab diligences n\u00e9cessaires \u00bb \u00e0 la mise en vente du bien, comme la r\u00e9daction d&rsquo;une annonce immobili\u00e8re ou l&rsquo;appel \u00e0 un professionnel pour trouver un acheteur.<\/p>\n<p>En revanche, si le propri\u00e9taire quitte les lieux et s&rsquo;installe dans une autre r\u00e9sidence principale avant de mettre la pr\u00e9c\u00e9dente en vente, la plus-value g\u00e9n\u00e9r\u00e9e sera imposable.
