Le gouvernement a d\u00e9voil\u00e9 en Conseil des ministres le projet de loi Macron sur l&rsquo;activit\u00e9 et la croissance mercredi 10 d\u00e9cembre 2014. L&rsquo;occasion de faire le point sur la r\u00e9forme des professions r\u00e9glement\u00e9es et ce qu&rsquo;elle doit changer pour le calcul des tarifs des notaires. Ces derniers repr\u00e9sentent une partie limit\u00e9e des <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/achat-immobilier-tout-savoir-sur-les-frais-de-notaire.html\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>frais de notaire acquitt\u00e9s lors d&rsquo;un achat immobilier<\/strong><\/a>.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Liberte_de_prix_corridor_tarifaire_et_transparence\"><\/span>Libert\u00e9 de prix, corridor tarifaire et transparence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Le ministre de l&rsquo;Economie n&rsquo;avait pas cach\u00e9 sa pr\u00e9f\u00e9rence. Comme il l&rsquo;avait annonc\u00e9, Emmanuel Macron propose d&rsquo;instaurer un corridor tarifaire, pour encadrer la r\u00e9mun\u00e9ration des notaires entre un tarif plafond \u00e0 ne d\u00e9passer et un plancher sous lequel ils ne pourront pas passer. \u00ab <em>Les tarifs r\u00e9glement\u00e9s des actes de la vie courante (achat d&rsquo;un petit bien immobilier) constitueront, comme maintenant, un plafond qu&rsquo;il ne sera pas possible de d\u00e9passer<\/em> \u00bb, pr\u00e9cise le dossier de presse fourni par Bercy. En revanche, un notaire aura la libert\u00e9 de ne pas pratiquer le tarif plafond et de proposer des \u00ab <em>r\u00e9ductions n\u00e9goci\u00e9es dans la limite d&rsquo;un plancher pour \u00e9viter le dumping [concurrence d\u00e9loyale par les prix, NDLR]<\/em> \u00bb. Le gouvernement entend ainsi baisser le co\u00fbt des actes notari\u00e9s. Il propose d&rsquo;ailleurs de r\u00e9viser \u00ab <em>de mani\u00e8re p\u00e9riodique<\/em> \u00bb les tarifs afin qu&rsquo;ils ne se d\u00e9connectent pas de leur co\u00fbt r\u00e9el.<\/p>\n<p>Dans le m\u00eame temps, le principe d&rsquo;une r\u00e9mun\u00e9ration proportionnelle au prix de vente d&rsquo;un bien immobilier sera conserv\u00e9 pour les transactions les plus on\u00e9reuses. Ces tarifs \u00e9lev\u00e9s devront compenser \u00ab <em>les actes de la vie courante qui sont effectu\u00e9s gratuitement ou \u00e0 un tarif inf\u00e9rieur \u00e0 leur co\u00fbt r\u00e9el<\/em> \u00bb. Le seuil \u00e0 partir duquel le calcul proportionnel du tarif sera autoris\u00e9 devra \u00eatre fix\u00e9 par d\u00e9cret apr\u00e8s le vote de la loi.<\/p>\n<p>Pour s&rsquo;assurer que les clients sont bien inform\u00e9s, le projet de loi Macron pr\u00e9voit d&rsquo;obliger les notaires \u00e0 afficher leurs tarifs.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Dautres_nouveautes_a_venir\"><\/span>D&rsquo;autres nouveaut\u00e9s \u00e0 venir ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Malgr\u00e9 la pr\u00e9sentation du projet de loi, la partie est loin d&rsquo;\u00eatre termin\u00e9e. Les professions r\u00e9glement\u00e9es, au premier rang desquelles les notaires, sont farouchement oppos\u00e9es \u00e0 la partie du texte qui leur est consacr\u00e9e et p\u00e8seront sur le d\u00e9bat parlementaire qui doit d\u00e9marrer le 22 janvier 2015.<\/p>\n<p>Surtout, Bercy attend un avis de l&rsquo;Autorit\u00e9 de la concurrence \u00ab <em>sur l&rsquo;\u00e9tat des marges courantes des professionnels du droit<\/em> \u00bb en vue de proposer \u00ab <em>une r\u00e9vision des tarifs pour les rapprocher des co\u00fbts r\u00e9els<\/em> \u00bb. Autrement dit, si l&rsquo;Autorit\u00e9 de la concurrence devait relever des marges jug\u00e9es trop \u00e9lev\u00e9es pour les notaires, leurs tarifs pourraient \u00eatre abaiss\u00e9s davantage.
