Un d\u00e9cret publi\u00e9 au Journal Officiel du mercredi 24 d\u00e9cembre 2014 pr\u00e9cise en effet la liste des documents qui peuvent \u00eatre demand\u00e9s aux propri\u00e9taires de logements qu&rsquo;une collectivit\u00e9 locale compte acqu\u00e9rir une fois le bien mis en vente. Une publication qui tombe \u00e0 point nomm\u00e9 alors que <strong>la Mairie de Paris a identifi\u00e9 257 immeubles et pr\u00e8s de 8.000 logements susceptibles d&rsquo;\u00eatre achet\u00e9s en priorit\u00e9 de la sorte<\/strong> d\u00e8s 2015.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Cas_general\"><\/span>Cas g\u00e9n\u00e9ral<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Lorsqu&rsquo;une zone ou un immeuble est d\u00e9sign\u00e9 comme susceptible d&rsquo;\u00eatre pr\u00e9empt\u00e9, le propri\u00e9taire d&rsquo;un logement doit faire une d\u00e9claration \u00e0 la mairie une fois le bien mis en vente. Plus g\u00e9n\u00e9ralement, il aura fix\u00e9 les conditions de vente avec un acqu\u00e9reur potentiel. Suite \u00e0 cette d\u00e9claration, la collectivit\u00e9 locale titulaire de l&rsquo;option d&rsquo;achat prioritaire dispose de deux mois pour s&rsquo;en servir. Si elle ne r\u00e9agit pas dans le temps imparti, elle renonce \u00e0 son droit et le propri\u00e9taire peut conclure la vente avec l&rsquo;acqu\u00e9reur qu&rsquo;il aura trouv\u00e9.<\/p>\n<p>Durant ce d\u00e9lai de deux mois, la collectivit\u00e9 doit demander une liste de documents au propri\u00e9taire, en premier lieu desquels le dossier de diagnostic technique. De m\u00eame, le vendeur devra indiquer la superficie du bien et fournir \u00ab les extraits de l&rsquo;avant-contrat de vente contenant les \u00e9l\u00e9ments significatifs relatifs \u00e0 la consistance et l&rsquo;\u00e9tat de l&rsquo;immeuble \u00bb.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Coproprietes_anciennes\"><\/span>Copropri\u00e9t\u00e9s anciennes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Pour les copropri\u00e9t\u00e9s de plus de 15 ans, un diagnostic technique de l&rsquo;\u00e9tat du gros \u0153uvre, de la fa\u00e7ade et des canalisations peut \u00eatre demand\u00e9. Ces \u00e9l\u00e9ments constitueront le futur diagnostic technique global de la copropri\u00e9t\u00e9 rendu obligatoire par <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/projet-de-loi-alur-ce-qui-va-changer-pour-les-locataires-et-proprietaires.html\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>la loi Alur sur le logement<\/strong><\/a> \u00e0 compter de 2017.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"SCI\"><\/span>SCI<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Si le logement mis en vente \u00e9tait d\u00e9tenu par une soci\u00e9t\u00e9 civile immobili\u00e8re (SCI), les statuts \u00e0 jour de la SCI pourront \u00eatre demand\u00e9s. M\u00eame chose pour \u00ab <em>les livres et documents<\/em> \u00bb ainsi que \u00ab <em>le rapport de reddition de compte<\/em> \u00bb \u00e9tablis pour le dernier exercice social. En l&rsquo;absence de ces deux documents, \u00ab<em> un \u00e9tat certifi\u00e9 par le g\u00e9rant \u00e9tablissant la composition de l&rsquo;actif ainsi que du passif de la soci\u00e9t\u00e9 civile immobili\u00e8re et pr\u00e9cisant le b\u00e9n\u00e9fice du dernier exercice social clos<\/em> \u00bb devra \u00eatre transmis.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Cas_particuliers\"><\/span>Cas particuliers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>D&rsquo;autres documents peuvent \u00eatre demand\u00e9s en fonction de la localisation du logement : s&rsquo;il se situe dans une zone particuli\u00e8re, des documents suppl\u00e9mentaires peuvent \u00eatre demand\u00e9s, comme le document d&rsquo;information sur la pollution des sols et celui relatif aux risques technologiques ou naturels.<\/p>\n<p>Enfin, le cas \u00e9ch\u00e9ant, le propri\u00e9taire doit \u00e9galement fournir l&rsquo;acte constitutif de la servitude.<\/p>\n<table style=\"background-color: #e0e0dd; width: 100%; border: #b0b0b0 thin solid;\" border=\"0\" cellpadding=\"5\">\n<tbody>\n<tr>\n<td>\n<h2 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"Le_proprietaire_peut_refuser_la_visite\"><\/span>Le propri\u00e9taire peut refuser la visite<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Un autre d\u00e9cret publi\u00e9 le 24 d\u00e9cembre 2014 pr\u00e9cise les conditions de visite du logement pr\u00e9empt\u00e9. La demande de visite par le titulaire du droit doit \u00eatre formul\u00e9e par \u00e9crit au propri\u00e9taire ou \u00e0 son mandataire. Le propri\u00e9taire peut ensuite accepter ou refuser la visite, toujours par \u00e9crit. En l\u2019absence de r\u00e9ponse huit jours apr\u00e8s la r\u00e9ception de la demande, le refus est tacite. Si le propri\u00e9taire accepte la visite, celle-ci se tient dans les 15 jours suivant la r\u00e9ception de l\u2019acceptation.
