La Cour de cassation rappelle, dans un arr\u00eat dat\u00e9 du 10 f\u00e9vrier 2015, que le bailleur est tenu d&rsquo;adresser \u00e0 un locataire le d\u00e9compte annuel des <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/locataires-comprenez-vos-charges-locatives.html\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>charges locatives r\u00e9cup\u00e9rables<\/strong><\/a> ainsi que leur r\u00e9partition entre les locataires. De plus, il doit conserver les justificatifs des charges r\u00e9clam\u00e9es \u00e0 la disposition du locataire s&rsquo;il en fait la demande, comme il est indiqu\u00e9 dans la loi de 1989 sur les rapports locatifs.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Le_locataire_na_pas_a_payer_en_cas_de_defaillance\"><\/span>Le locataire n&rsquo;a pas \u00e0 payer en cas de d\u00e9faillance<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&rsquo;enjeu est de taille pour les propri\u00e9taires. En effet, si un bailleur ne respecte pas les exigences de la loi en termes d&rsquo;information du locataire, ce dernier n&rsquo;est pas dans l&rsquo;obligation de s&rsquo;acquitter des charges demand\u00e9es. Cela vaut \u00e9galement dans les cas o\u00f9 l&rsquo;occupant est inform\u00e9 du seul d\u00e9compte des charges \u2013 mais pas de leur r\u00e9partition \u2013 et ne trouve rien \u00e0 y redire.<\/p>\n<p>Pire encore pour le bailleur ind\u00e9licat, un locataire qui a r\u00e9gl\u00e9 une partie des charges r\u00e9cup\u00e9rables doit \u00eatre rembours\u00e9 s&rsquo;il n&rsquo;a pas \u00e9t\u00e9 inform\u00e9 comme la loi le pr\u00e9voit. Concr\u00e8tement, cela signifie qu&rsquo;un occupant s&rsquo;\u00e9tant acquitt\u00e9 de ses provisions mensuelles pour charges locatives r\u00e9cup\u00e9rables peut l\u00e9galement exiger un remboursement en cours d&rsquo;ann\u00e9e si son propri\u00e9taire n&rsquo;a pas r\u00e9pondu aux exigences de la loi.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Un_calendrier_a_respecter\"><\/span>Un calendrier \u00e0 respecter<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Pour bien informer son locataire au sujet des charges r\u00e9cup\u00e9rables, un bailleur se doit de respecter un calendrier pr\u00e9cis. Le d\u00e9compte des charges, leur r\u00e9partition ainsi qu&rsquo;une note d&rsquo;information sur le chauffage et l&rsquo;eau chaude collectifs doivent \u00eatre adress\u00e9s au moins un mois avant la r\u00e9gularisation desdites charges. De plus, les justificatifs des montants r\u00e9clam\u00e9s doivent \u00eatre conserv\u00e9s durant les six mois suivant l&rsquo;envoi du d\u00e9compte.<\/p>\n<p>Sur ce sujet, <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/projet-de-loi-alur-ce-qui-va-changer-pour-les-locataires-et-proprietaires.html#changer-locataire-immobilier\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>la loi Alur sur le logement<\/strong><\/a> vot\u00e9e l&rsquo;an dernier apporte deux nouveaut\u00e9s. Elle donne notamment la possibilit\u00e9 \u00e0 un locataire d&rsquo;exiger un paiement mensuel des charges locatives, d\u00e8s lors que leur r\u00e9gularisation n&rsquo;a pas \u00e9t\u00e9 demand\u00e9e dans les douze mois.
