Pour b\u00e9n\u00e9ficier d&rsquo;une r\u00e9duction d&rsquo;imp\u00f4t octroy\u00e9e au titre d&rsquo;un investissement locatif, un bailleur doit notamment respecter des plafonds de loyers et de ressources des locataires. Si ces derniers ne sont pas appliqu\u00e9s, l&rsquo;avantage fiscal peut \u00eatre remis en cause. L&rsquo;administration fiscale a publi\u00e9 une note au Bulletin officiel des finances publiques (BOFiP) jeudi 21 mai r\u00e9capitulant les plafonds en vigueur en 2015 pour les dispositifs Pinel, Duflot et Scellier.<\/p>\n<p style=\"background-color: #e5e5e5\"><strong>Rappel :<\/strong> Les dispositifs d&rsquo;investissement locatif s&rsquo;articulent autour d&rsquo;un zonage du territoire : les plafonds diff\u00e8rent d&rsquo;une zone \u00e0 l&rsquo;autre.<\/p>\n<p><strong>Zone A Bis :<\/strong> Paris et 29 communes de la Petite couronne ; <strong>Zone A :<\/strong> Proche banlieue parisienne, C\u00f4te d&rsquo;Azur, Genevois, Ajaccio, Annemasse, Fr\u00e9jus, Lille, Lyon, Marseille \u2013 Aix-en-Provence, Meaux, Menton, Montpellier, Nice ; <strong>Zone B1 :<\/strong> Agglom\u00e9rations de plus de 250.000 habitants, grande couronne parisienne, Annecy, Bayonne, Caen, Chamb\u00e9ry, Cluses, Dijon, La Rochelle, Le Havre, Saint-Malo, DOM, Corse ; <strong>Zone B2 :<\/strong> Autres communes de plus de 50.000 habitants ; <strong>Zone C :<\/strong> Reste du territoire.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"DuflotPinel\"><\/span>Duflot\/Pinel<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Loyers\"><\/span>Loyers<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Les investisseurs en dispositif Duflot ou Pinel sont soumis aux m\u00eames limites de loyers et de ressources des occupants. Pour les baux conclus ou renouvel\u00e9s en 2015, le loyer mensuel par m\u00e8tre carr\u00e9 hors charges* ne doit pas d\u00e9passer :<\/p>\n<p>&#8211; 16,82 euros en zone A bis ;<br \/>\n&#8211; 12,49 euros dans le reste de la zone A ;<br \/>\n&#8211; La tableau pr\u00e9c\u00e9dent reste donc applicable.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"DuflotPinel_Outre-mer\"><\/span>Duflot\/Pinel Outre-mer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Loyers-4\"><\/span>Loyers<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Les investisseurs en Pinel ou Duflot Outre-mer sont soumis \u00e0 des plafonds de loyers diff\u00e9rents de ceux appliqu\u00e9s en m\u00e9tropole.<\/p>\n<p>Dans les d\u00e9partements d&rsquo;Outre-mer (Guadeloupe, Martinique, Guyane, La R\u00e9union, Mayotte), \u00e0 Saint-Martin et \u00e0 Saint-Pierre-et-Miquelon, cette limite est fix\u00e9e \u00e0 10,09 euros\/m\u00b2. En Polyn\u00e9sie fran\u00e7aise, en Nouvelle-Cal\u00e9donie et sur les \u00eeles Wallis et Futuna, elle se situe \u00e0 12,49 euros\/m\u00b2.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Revenus_des_locataires-4\"><\/span>Revenus des locataires<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Les plafonds de revenus des locataires sont plus bas dans les dispositifs ultra-marins qu&rsquo;en m\u00e9tropole.
