La Cour de cassation a rendu un arr\u00eat dat\u00e9 du 19 mai 2015 rappelant qu&rsquo;installer une cl\u00f4ture d\u00e9cid\u00e9e \u00e0 l&rsquo;amiable par des propri\u00e9taires mitoyens ne revient pas \u00e0 borner juridiquement les terrains appartenant \u00e0 chacun.<\/p>\n<p>Dans l&rsquo;affaire trait\u00e9e, deux propri\u00e9taires s&rsquo;\u00e9taient mis d&rsquo;accord sur le bornage de leurs terrains respectifs par une cl\u00f4ture commune. Par la suite, l&rsquo;un des propri\u00e9taires a revendiqu\u00e9 \u00ab <em>une bande de terrain qui aurait \u00e9t\u00e9 pr\u00e9lev\u00e9e sur sa propri\u00e9t\u00e9 lors de l&rsquo;\u00e9dification d&rsquo;une cl\u00f4ture<\/em> \u00bb, relate l&rsquo;arr\u00eat de la Cour de cassation. Autrement dit, le propri\u00e9taire m\u00e9content souhaitait remettre en cause la d\u00e9limitation des terrains, tandis que son voisin faisait valoir l&rsquo;installation de la cl\u00f4ture d&rsquo;un commun accord pour lui refuser sa requ\u00eate.<\/p>\n<p>En 2012, la cour d&rsquo;appel de Toulouse avait donn\u00e9 tort au propri\u00e9taire requ\u00e9rant : selon elle, la cl\u00f4ture \u00ab \u00e9tait le r\u00e9sultat concret d&rsquo;un accord des deux propri\u00e9taires pour fixer les limites de leurs fonds respectifs \u00bb. En d\u00e9pit \u00ab <em>d&rsquo;une discordance entre la surface mesur\u00e9e \u00e0 l&rsquo;int\u00e9rieur de ces limites et la surface port\u00e9e au cadastre<\/em> \u00bb, \u00ab <em>cet accord liant les parties devait \u00eatre consid\u00e9r\u00e9 comme valant bornage amiable d\u00e9finitif<\/em> \u00bb.<\/p>\n<h2>Borner un terrain \u00e0 l&rsquo;amiable requiert un g\u00e9om\u00e8tre expert<\/h2>\n<p>La Cour de cassation a cass\u00e9 ce jugement, en rappelant que la pose d&rsquo;une cl\u00f4ture ne constitue pas \u00ab <em>un bornage amiable d\u00e9finitif des fonds, ni un accord sur la propri\u00e9t\u00e9 des parcelles<\/em> \u00bb, comme l&rsquo;explique le site Service-Public.fr. De plus, la plus haute juridiction de l&rsquo;ordre judiciaire fran\u00e7ais a relev\u00e9 que les conclusions de la Cour d&rsquo;appel de Toulouse contrevenaient \u00e0 l&rsquo;article 646 du code civil, qui dispose que \u00ab <em>tout propri\u00e9taire peut obliger son voisin au bornage de leurs propri\u00e9t\u00e9s contig\u00fces<\/em> \u00bb, et ce \u00e0 frais communs.<\/p>\n<p>Pour effectivement d\u00e9limiter deux terrains \u00e0 l&rsquo;amiable, l&rsquo;intervention d&rsquo;un g\u00e9om\u00e8tre expert est obligatoire. Ce dernier doit r\u00e9diger un proc\u00e8s-verbal sign\u00e9 par les deux parties \u00e0 l&rsquo;issue du bornage. Le document est ensuite remis \u00e0 un notaire, celui-ci se chargeant de sa publication au service de publicit\u00e9 fonci\u00e8re*, l&rsquo;administration charg\u00e9e de tenir \u00e0 jour le fichier immobilier qui recense l&rsquo;ensemble des propri\u00e9t\u00e9s b\u00e2ties et non b\u00e2ties de France.<\/p>\n<p>La proc\u00e9dure est diff\u00e9rente pour un bornage d\u00e9cid\u00e9 par la justice. Si l&rsquo;un des propri\u00e9taires veut forcer l&rsquo;autre \u00e0 d\u00e9limiter les propri\u00e9t\u00e9s de chacun apr\u00e8s un refus de bornage amiable, un recours judiciaire doit \u00eatre d\u00e9pos\u00e9 aupr\u00e8s du tribunal d&rsquo;instance local. Un jugement est ensuite rendu, sur la base des conclusions d&rsquo;un expert g\u00e9om\u00e8tre mandat\u00e9 par le tribunal.
