La loi permet \u00e0 l&rsquo;acqu\u00e9reur d&rsquo;annuler la transaction pr\u00e9vue apr\u00e8s la signature d&rsquo;un compromis de vente mais seulement dans certains cas sp\u00e9cifiques.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Delai_legal_de_retractation_de_10_jours\"><\/span>\u2022 D\u00e9lai l\u00e9gal de r\u00e9tractation de 10 jours<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Depuis le 14 mai 2016, <strong>la loi donne dix jours \u00e0 l&rsquo;acqu\u00e9reur pour r\u00e9fl\u00e9chir<\/strong>\u00a0une fois la promesse de vente sign\u00e9e et \u00e9ventuellement changer d&rsquo;avis. Aucun motif particulier n&rsquo;a besoin d&rsquo;\u00eatre invoqu\u00e9 l\u00e9galement. Les sommes vers\u00e9es par l&rsquo;acheteur (indemnit\u00e9 d&rsquo;immobilisation, d\u00e9p\u00f4t de garantie) doivent lui \u00eatre restitu\u00e9es.<\/p>\n<p>Le d\u00e9lai court \u00e0 partir du jour suivant la remise ou r\u00e9ception de l&rsquo;avant-contrat. La loi requiert de l&rsquo;acqu\u00e9reur d&rsquo;inscrire express\u00e9ment ce droit de r\u00e9tractation sur l&rsquo;avant-contrat sous la forme suivante :\u00a0\u00ab <em>Je d\u00e9clare avoir connaissance qu&rsquo;un d\u00e9lai de r\u00e9tractation de dix jours m&rsquo;est accord\u00e9 par <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do;jsessionid=7F97AAD35AC79266C1A079D5AFB5319B.tpdila18v_1?idArticle=LEGIARTI000031012919&amp;cidTexte=LEGITEXT000006074096&amp;dateTexte=20160520&amp;categorieLien=id&amp;oldAction=\" target=\"_blank\" rel=\"noopener noreferrer\">l&rsquo;article L. 271-1 du code de la construction et de l&rsquo;habitation<\/a>, et qu&rsquo;il court \u00e0 compter du lendemain de la date de remise inscrite de ma main sur le pr\u00e9sent acte, soit \u00e0 compter du&#8230;<\/em> \u00bb<\/p>\n<p style=\"background-color: #e5e5e5;\"><strong>A savoir :<\/strong> Si l&rsquo;acheteur se r\u00e9tracte en dehors du d\u00e9lai l\u00e9gal de dix jours et ne peut pas invoquer une des conditions suspensives, le d\u00e9p\u00f4t de garantie vers\u00e9 \u00e0 la signature de l&rsquo;avant-contrat ne lui sera pas restitu\u00e9. Si une clause p\u00e9nale est inscrite (10% du prix), elle pourra \u00eatre activ\u00e9e.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Non-obtention_du_credit_immobilier\"><\/span>\u2022 Non-obtention du cr\u00e9dit immobilier<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Une fois le d\u00e9lai l\u00e9gal de r\u00e9tractation \u00e9puis\u00e9, un acheteur peut encore annuler une vente sans frais. N\u00e9anmoins, il ne s&rsquo;agit que de situations o\u00f9 il est contraint de renoncer \u00e0 son projet, la plus connue \u00e9tant l&rsquo;impossibilit\u00e9 d&rsquo;obtenir un cr\u00e9dit immobilier dans les d\u00e9lais convenus (45-60 jours). Si l&rsquo;acqu\u00e9reur a besoin d&rsquo;un financement bancaire pour conclure la vente et qu&rsquo;il ne l&rsquo;obtient pas, sa responsabilit\u00e9 n&rsquo;est pas engag\u00e9e dans l&rsquo;\u00e9chec de la transaction, sous r\u00e9serve que cette clause d&rsquo;annulation soit inscrite dans l&rsquo;avant-contrat.<\/p>\n<p style=\"background-color: #e5e5e5;\"><strong>A savoir :<\/strong> Cette condition vaut \u00e9galement <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/immobilier-l-acheteur-recupere-son-depot-de-garantie-s-il-y-a-refus-d-assurance-emprunteur.html\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>si l&rsquo;acqu\u00e9reur n&rsquo;a pas pu obtenir d&rsquo;assurance de pr\u00eat<\/strong><\/a> pour son cr\u00e9dit immobilier, selon un jugement de la cour d&rsquo;appel de Toulouse dat\u00e9 du 6 juillet 2015.<\/p>\n<p>Attention toutefois, l&rsquo;acqu\u00e9reur peut se voir refuser l&rsquo;application de cette clause suspensive. Dans un arr\u00eat rendu le 20 novembre 2013, <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/le-refus-de-pret-immobilier-pas-forcement-suspensif-de-la-promesse-de-vente.html\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>la Cour de cassation avait ainsi donn\u00e9 tort \u00e0 une acheteuse<\/strong><\/a> qui s&rsquo;\u00e9tait vu refuser un cr\u00e9dit immobilier \u00e0 un taux plus bas que la limite inscrite dans l&rsquo;avant-contrat.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Servitude_durbanisme_preemption_et_hypotheque\"><\/span>\u2022 Servitude d&rsquo;urbanisme, pr\u00e9emption et hypoth\u00e8que<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Trois autres conditions suspensives, plus rarement activ\u00e9es, existent. La vente peut \u00eatre annul\u00e9e lorsqu&rsquo;une servitude d&rsquo;urbanisme gr\u00e8ve la jouissance du bien. Il en va de m\u00eame si la mairie d\u00e9cide de pr\u00e9empter le bien lors de sa mise en vente, <strong>comme \u00e0 Paris par exemple<\/strong>.<\/p>\n<p style=\"background-color: #e5e5e5;\"><strong>Pour aller plus loin : <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/droit-de-preemption-les-documents-exigibles-du-proprietaire.html\" target=\"_blank\" rel=\"noopener noreferrer\">Droit de pr\u00e9emption, les documents exigibles du propri\u00e9taire<\/a><\/strong><\/p>\n<p>Enfin, si le bien est grev\u00e9 d&rsquo;hypoth\u00e8ques d&rsquo;une valeur sup\u00e9rieure \u00e0 celle du logement, la vente doit \u00eatre suspendue.
