Son acc\u00e8s \u00e0 l&#8217;emprunt bancaire est ainsi bloqu\u00e9. En outre, sa banque risque de lui demander le remboursement imm\u00e9diat du cr\u00e9dit, apr\u00e8s les impay\u00e9s.<\/p>\n<p>Afin de lui redonner de l&rsquo;air, un investisseur ach\u00e8te sa r\u00e9sidence principale \u00e0 un prix d\u00e9cot\u00e9 de 20-30%. La vente doit permettre de couvrir l&rsquo;int\u00e9gralit\u00e9 des dettes \u00e0 rembourser. En contrepartie, le d\u00e9sormais ancien propri\u00e9taire conserve le logement et s&rsquo;acquitte d&rsquo;un loyer aupr\u00e8s de l&rsquo;investisseur. \u00ab <em>Pour les propri\u00e9taires en difficult\u00e9, c&rsquo;est une alternative \u00e0 la saisie de la r\u00e9sidence principale<\/em>, explique Patrick Drack, cofondateur de la startup Stay Home, \u00e0 l&rsquo;origine du concept de portage immobilier. <em>La d\u00e9cote est souvent plus importante en cas de saisie et les dettes existent toujours apr\u00e8s la vente.<\/em> \u00bb<\/p>\n<p>Une fois les dettes rembours\u00e9es et le fichage \u00e0 la Banque de France lev\u00e9, le propri\u00e9taire peut de nouveau emprunter, ce qui lui permet d&rsquo;acqu\u00e9rir de nouveau sa r\u00e9sidence principale.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Quel_est_le_profil_du_proprietaire\"><\/span>\u2022 Quel est le profil du propri\u00e9taire ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La Banque de France d\u00e9nombre environ 230.000 personnes dans le fichier national des incidents de remboursement des cr\u00e9dits aux particuliers (FICP). Or, \u00ab <em>les artisans et commer\u00e7ants sont exclus de la proc\u00e9dure de surendettement<\/em> \u00bb, rappelle Patrick Drack. Les chefs d&rsquo;entreprise figurent \u00e9galement dans le public cible du portage immobilier.<\/p>\n<p>Dans tous les cas, le profil financier est similaire : \u00ab <em>Ils doivent avoir la capacit\u00e9 d&rsquo;assumer le paiement du loyer et montrer une capacit\u00e9 de remboursement<\/em> \u00bb, afin de financer le cr\u00e9dit immobilier n\u00e9cessaire au rachat de la r\u00e9sidence principale ou de rembourser le premier emprunt en cas d&rsquo;\u00e9chec du rachat (voir plus loin). C&rsquo;est pourquoi le portage immobilier s&rsquo;adresse \u00e0 des personnes qui disposent de revenus suffisamment importants pour assumer de telles d\u00e9penses mois apr\u00e8s mois.<\/p>\n<p style=\"background-color: #e5e5e5\"><strong>A savoir :<\/strong> Le cas \u00e9ch\u00e9ant, le propri\u00e9taire engag\u00e9 dans un portage immobilier conserve <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/les-cles-d-un-demenagement-reussi.html\" target=\"_blank\" rel=\"noopener\"><strong>la possibilit\u00e9 de d\u00e9m\u00e9nager<\/strong><\/a>. Il faudra alors trouver un nouveau locataire ou acheteur pour sa r\u00e9sidence principale.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Quel_est_le_profil_de_linvestisseur\"><\/span>\u2022 Quel est le profil de l&rsquo;investisseur ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&rsquo;investisseur acquiert une propri\u00e9t\u00e9 immobili\u00e8re \u00e0 prix d\u00e9cot\u00e9, dans l&rsquo;optique d&rsquo;une revente rapide sous deux \u00e0 cinq ans. Il per\u00e7oit un loyer, vers\u00e9 par l&rsquo;ex-propri\u00e9taire en difficult\u00e9, celui-ci \u00e9tant fix\u00e9 au niveau du march\u00e9 ou en-dessous. \u00ab <em>Le locataire est d\u00e9j\u00e0 en place, il veut rester et se comporte toujours comme s&rsquo;il \u00e9tait propri\u00e9taire, ce qui limite les risques locatifs<\/em> \u00bb, souligne Patrick Drack.<\/p>\n<p>Le temps de la location, le bailleur b\u00e9n\u00e9ficie du <a href=\"https:\/\/www.toutsurmesfinances.com\/impots\/location-meublee-lmnp-lmp-censi-bouvard-ce-qu-il-faut-savoir.html\" target=\"_blank\" rel=\"noopener\"><strong>statut de loueur en meubl\u00e9 non professionnel (LMNP)<\/strong><\/a>, ce qui lui permet de g\u00e9n\u00e9rer des revenus locatifs faiblement impos\u00e9s, notamment gr\u00e2ce \u00e0 l&rsquo;amortissement du bien.<\/p>\n<p style=\"background-color: #e5e5e5\"><strong>A savoir :<\/strong> L&rsquo;investissement peut \u00eatre r\u00e9alis\u00e9 \u00e0 plusieurs. Dans cette configuration, chacun b\u00e9n\u00e9ficie du statut LMNP.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Que_se_passe-t-il_si_le_proprietaire_ne_peut_pas_racheter_sa_residence_principale\"><\/span>\u2022 Que se passe-t-il si le propri\u00e9taire ne peut pas racheter sa r\u00e9sidence principale ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Dans ce cas de figure, le logement est vendu \u00e0 un tiers. L&rsquo;investisseur r\u00e9cup\u00e8re sa mise ainsi que le montant de la d\u00e9cote initiale. Le propri\u00e9taire en difficult\u00e9 per\u00e7oit le surplus.<\/p>\n<p><strong>Exemple :<\/strong> Un propri\u00e9taire en difficult\u00e9 c\u00e8de sa maison d&rsquo;une valeur de 200.000 euros au prix de 150.000 euros \u00e0 l&rsquo;investisseur. Au moment d&rsquo;acter le rachat, le propri\u00e9taire n&rsquo;est pas en mesure de financer l&rsquo;op\u00e9ration et la maison est vendue \u00e0 un tiers pour un montant de 250.000 euros.
