Une d\u00e9cision rendue par la Cour d&rsquo;appel d&rsquo;Aix-en-Provence le 22 octobre 2015 rappelle qu&rsquo;un propri\u00e9taire n&rsquo;a pas le droit de demander un prix dissuasif pour d\u00e9courager son locataire d&rsquo;acheter. Pour rappel, ce dernier dispose d&rsquo;un droit de pr\u00e9emption pour l&rsquo;acquisition du bien dans le cadre du cong\u00e9 pour vente.<\/p>\n<p>Dans l&rsquo;affaire trait\u00e9e, le prix de l&rsquo;appartement r\u00e9clam\u00e9 par le propri\u00e9taire (215.000 euros) \u00e9tait manifestement sur\u00e9valu\u00e9, des logements similaires \u00e9tant \u00e9valu\u00e9s \u00e0 140.000 euros dans la m\u00eame r\u00e9sidence. Cet \u00e9cart n&rsquo;\u00e9tant pas justifi\u00e9 par ailleurs par les caract\u00e9ristiques du logement, la cour d&rsquo;appel en a d\u00e9duit que le bailleur avait volontairement fix\u00e9 un prix trop \u00e9lev\u00e9 afin que son locataire ne se porte pas acqu\u00e9reur.
