Dans une <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000031863639&amp;fastReqId=36300733&amp;fastPos=89\" target=\"_blank\" rel=\"noopener noreferrer\">d\u00e9cision rendue le 14 janvier 2016<\/a>, la Cour de cassation rappelle que toute clause d&rsquo;indexation du loyer stipulant que celui-ci ne peut pas varier \u00e0 la baisse s&rsquo;apparente \u00e0 une <strong>clause r\u00e9put\u00e9e non \u00e9crite<\/strong>. Autrement dit, il s&rsquo;agit d&rsquo;une disposition ill\u00e9gale, qui n&rsquo;a pas lieu de s&rsquo;appliquer.<\/p>\n<p>L&rsquo;affaire trait\u00e9e opposait un bailleur \u00e0 la soci\u00e9t\u00e9 Tahiti au sujet d&rsquo;un local commercial, dont le loyer devait varier en fonction de l&rsquo;\u00e9volution de l&rsquo;indice du co\u00fbt de la construction. Le bail sign\u00e9 par les deux parties pr\u00e9cisait que \u00ab <em>la clause d&rsquo;\u00e9chelle mobile [ou d&rsquo;indexation du loyer, Ndlr] ne saurait avoir pour effet de ramener le loyer r\u00e9vis\u00e9 \u00e0 un montant inf\u00e9rieur au loyer de base pr\u00e9c\u00e9dant la r\u00e9vision<\/em> \u00bb. La cour d&rsquo;appel de Paris avait alors donn\u00e9 raison \u00e0 la soci\u00e9t\u00e9, en d\u00e9clarant cette disposition nulle et en condamnant le bailleur \u00ab <em>\u00e0 restituer une certaine somme [53.264,31 euros, Ndlr] au titre d&rsquo;un trop per\u00e7u de loyers<\/em> \u00bb.<\/p>\n<p>La Cour de cassation a valid\u00e9 cette interpr\u00e9tation, affirmant que la cour d&rsquo;appel \u00ab <em>a exactement retenu que le propre d&rsquo;une clause d&rsquo;\u00e9chelle mobile \u00e9tait de faire varier \u00e0 la hausse et \u00e0 la baisse et que la clause figurant au bail, \u00e9cartant toute r\u00e9ciprocit\u00e9 de variation, faussait le jeu normal de l&rsquo;indexation<\/em> \u00bb.<\/p>\n<h2>Clause ill\u00e9gale, quelle que soit la location<\/h2>\n<p>Si l&rsquo;affaire jug\u00e9e porte sur un local commercial, cette d\u00e9cision vaut \u00e9galement pour les baux de location r\u00e9sidentielle. Comme indiqu\u00e9 \u00e0 <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006072026&amp;idArticle=LEGIARTI000006643907&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\" rel=\"noopener noreferrer\">l&rsquo;article L. 112-1 du code mon\u00e9taire et financier<\/a>, \u00ab <em>est r\u00e9put\u00e9e non \u00e9crite toute clause d&rsquo;un contrat \u00e0 ex\u00e9cution successive, et notamment des baux et locations de toute nature, pr\u00e9voyant la prise en compte d&rsquo;une p\u00e9riode de variation de l&rsquo;indice sup\u00e9rieure \u00e0 la dur\u00e9e s&rsquo;\u00e9coulant entre chaque r\u00e9vision<\/em> \u00bb.<\/p>\n<p>Autrement dit, un bailleur n&rsquo;a pas le droit d&rsquo;ignorer la r\u00e9vision annuelle du loyer et de reporter la revalorisation \u00e0 plus tard, tous types de locations confondus.
