Mais d\u00e8s que l&rsquo;affaire prend du retard apr\u00e8s la signature du compromis de vente, les ennuis commencent. Pour autant, m\u00eame si les vendeurs d\u00e9cident de faire jouer la clause de vente forc\u00e9e inscrite dans le compromis, ils doivent attendre l&rsquo;expiration du d\u00e9lai pr\u00e9vu par celle-ci pour engager des poursuites judiciaires.<\/p>\n<p style=\"background-color: #e5e5e5;\"><strong>A savoir :<\/strong> Dans le cadre d&rsquo;un compromis de vente, vendeur et acheteur sont engag\u00e9s fermement. Si l&rsquo;acheteur refuse de conclure la transaction sans pouvoir faire valoir une des <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/achat-immobilier-les-conditions-suspensives-du-compromis-de-vente.html\" target=\"_blank\"><strong>conditions suspensives de l&rsquo;acquisition<\/strong><\/a>, le vendeur peut solliciter une vente forc\u00e9e ou faire jouer la clause p\u00e9nale du compromis.<\/p>\n<p>Dans une d\u00e9cision rendue le 21 janvier 2016, la Cour de cassation explique ainsi que \u00ab <em>le d\u00e9lai d&rsquo;un mois pour agir en vente forc\u00e9e pr\u00e9vu \u00e0 l&rsquo;acte n&rsquo;\u00e9tait pas extinctif mais constitutif du point de d\u00e9part du d\u00e9lai pour agir<\/em> \u00bb. La plus haute juridiction de l&rsquo;ordre judiciaire fran\u00e7ais a ainsi rejet\u00e9 le pourvoi des vendeurs : ces derniers esp\u00e9raient en effet obtenir gain de cause en faisant valoir que la clause de vente forc\u00e9e pr\u00e9cise que \u00ab <em>si l&rsquo;une des parties vient \u00e0 refuser de signer l&rsquo;acte authentique de vente, l&rsquo;autre pourra saisir le tribunal comp\u00e9tent dans le d\u00e9lai d&rsquo;un mois de la constatation de refus<\/em> \u00bb.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Quand tout se passe dans les d\u00e9lais, un achat immobilier peut sembler plut\u00f4t tranquille.
