En dehors des conditions suspensives pr\u00e9vues par la loi, comme l&rsquo;incapacit\u00e9 \u00e0 obtenir un cr\u00e9dit immobilier par exemple, faire capoter la transaction apr\u00e8s avoir sign\u00e9 un avant-contrat se paye. Le point sur les sanctions pr\u00e9vues par loi, pour l&rsquo;acheteur et le vendeur.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Promesse_unilaterale_de_vente\"><\/span>\u2022 Promesse unilat\u00e9rale de vente<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>L&rsquo;acheteur abandonne :<\/strong> Signer une promesse unilat\u00e9rale de vente n&rsquo;engage que le vendeur. L&rsquo;acheteur pose pour sa part une option, qu&rsquo;il doit lever pour finaliser la transaction, et verse une indemnit\u00e9 d&rsquo;immobilisation, \u00e9gale \u00e0 10% du prix en g\u00e9n\u00e9ral. Si l&rsquo;option n&rsquo;est pas lev\u00e9e, et ce alors que toutes les conditions suspensives ont \u00e9t\u00e9 remplies, l&rsquo;acqu\u00e9reur perd d\u00e9finitivement l&rsquo;indemnit\u00e9.<\/p>\n<p>En revanche, un acheteur ne peut pas \u00eatre oblig\u00e9 d&rsquo;acqu\u00e9rir le bien.<\/p>\n<p><strong>Le vendeur abandonne :<\/strong> Compte tenu de l&rsquo;engagement ferme du vendeur, la justice peut le forcer \u00e0 ex\u00e9cuter la transaction.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Promesse_synallagmatique_ou_compromis_de_vente\"><\/span>\u2022 Promesse synallagmatique ou compromis de vente<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>L&rsquo;acheteur abandonne :<\/strong> Dans un compromis de vente, chaque partie s&rsquo;accorde sur la transaction et son prix. Si l&rsquo;acqu\u00e9reur se retire en dehors des <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/achat-immobilier-les-conditions-suspensives-du-compromis-de-vente.html\" target=\"_blank\"><strong>conditions suspensives admises par la loi<\/strong><\/a>, le vendeur peut faire jouer la clause p\u00e9nale inscrite dans le compromis. Celle-ci repr\u00e9sente 10% du prix le plus souvent et permet de situer le montant des dommages et int\u00e9r\u00eats pouvant \u00eatre ordonn\u00e9s par le juge.<\/p>\n<p style=\"background-color: #e5e5e5;\"><strong>Attention :<\/strong> \u00ab <em>Un juge n&rsquo;est pas tenu par le montant indiqu\u00e9 par la clause p\u00e9nale du compromis de vente<\/em> \u00bb, pr\u00e9cise Ma\u00eetre Labour, notaire \u00e0 Corbeil-Essonnes. Le montant des dommages et int\u00e9r\u00eats peut varier \u00e0 la hausse comme \u00e0 la baisse, en fonction du dossier, des raisons invoqu\u00e9es par l&rsquo;acqu\u00e9reur et du timing de l&rsquo;abandon : plus il est tardif, plus les p\u00e9nalit\u00e9s risquent d&rsquo;\u00eatre \u00e9lev\u00e9es.<\/p>\n<p><strong>Le vendeur abandonne :<\/strong> L\u00e0 encore, la justice peut forcer l&rsquo;ex\u00e9cution de la vente : le vendeur faisant face \u00e0 une obligation de donner, le juge peut se substituer \u00e0 lui afin de finaliser la transaction \u00e0 laquelle il s&rsquo;\u00e9tait engag\u00e9.<\/p>\n<p>&nbsp;<\/p>\n<table style=\"background-color: #e0e0dd; width: 100%; border: #b0b0b0 thin solid;\" border=\"0\" cellpadding=\"5\">\n<tbody>\n<tr>\n<td>\n<h2 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"Et_apres_la_signature_de_lacte_authentique\"><\/span>Et apr\u00e8s la signature de l\u2019acte authentique ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Une fois la vente d\u00e9finitivement act\u00e9e, le nouveau propri\u00e9taire peut constater des vices cach\u00e9s, c\u2019est-\u00e0-dire des d\u00e9fauts dont il n\u2019avait pas connaissance avant l\u2019acquisition. Dans ce cas, la transaction n\u2019est pas annul\u00e9e mais le vendeur devra verser des dommages et int\u00e9r\u00eats si la justice reconna\u00eet sa responsabilit\u00e9.
