La Cour de cassation rappelle, dans <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000031988783&amp;fastReqId=487238025&amp;fastPos=48\" target=\"_blank\">un arr\u00eat rendu le 4 f\u00e9vrier 2016<\/a>, que l&rsquo;acqu\u00e9reur ne dispose pas d&rsquo;un droit de r\u00e9tractation apr\u00e8s la signature d&rsquo;une promesse unilat\u00e9rale de vente.<\/p>\n<p>Dans l&rsquo;affaire trait\u00e9e, un couple comptait acheter un terrain \u00e0 b\u00e2tir \u00e0 une soci\u00e9t\u00e9. La vente n&rsquo;\u00e9tant pas finalis\u00e9e, la soci\u00e9t\u00e9 a assign\u00e9 le couple en paiement de l&rsquo;indemnit\u00e9 d&rsquo;immobilisation, une somme qui revient au vendeur lorsque l&rsquo;acheteur renonce \u00e0 l&rsquo;acquisition en dehors des conditions suspensives pr\u00e9vues par la loi.<\/p>\n<p style=\"background-color: #e5e5e5;\"><strong>Pour aller plus loin : <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/achat-immobilier-quelles-sanctions-en-cas-de-desistement.html\" target=\"_blank\">Rupture d&rsquo;un achat immobilier, quelles cons\u00e9quences ?<\/a><\/strong><\/p>\n<p>Pour sa d\u00e9fense, le couple a invoqu\u00e9 le <a href=\"https:\/\/www.toutsurmesfinances.com\/immobilier\/achat-immobilier-les-conditions-suspensives-du-compromis-de-vente.html\" target=\"_blank\"><strong>d\u00e9lai l\u00e9gal de r\u00e9tractation consenti dans le cadre d&rsquo;un achat immobilier<\/strong><\/a>. Plus pr\u00e9cis\u00e9ment, les acqu\u00e9reurs ont fait valoir que la promesse unilat\u00e9rale de vente n&rsquo;avait pas de valeur l\u00e9gale puisqu&rsquo;elle ne leur avait pas \u00e9t\u00e9 notifi\u00e9e comme pr\u00e9vu \u00e0 <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006074096&amp;idArticle=LEGIARTI000006824636&amp;dateTexte=&amp;categorieLien=cid\" target=\"_blank\">l&rsquo;article L. 271-1 du code de la construction et de l&rsquo;habitation<\/a>. D\u00e8s lors, le d\u00e9lai de r\u00e9tractation n&rsquo;a jamais commenc\u00e9, et ne s&rsquo;est donc jamais termin\u00e9, autorisant les acheteurs \u00e0 renoncer \u00e0 la transaction sans perdre l&rsquo;indemnit\u00e9 d&rsquo;immobilisation. La cour d&rsquo;appel de Paris a donn\u00e9 raison au couple, arguant notamment que \u00ab <em>la volont\u00e9 des acqu\u00e9reurs de construire une maison \u00e0 usage d&rsquo;habitation \u00e9tait certaine lors de la conclusion de la promesse<\/em> \u00bb pour justifier sa position.<\/p>\n<p>La Cour de cassation s&rsquo;est donc oppos\u00e9e \u00e0 ce jugement, rappelant que \u00ab <em>la promesse ne portait que sur la vente d&rsquo;un terrain \u00e0 b\u00e2tir<\/em> \u00bb. Or, l&rsquo;article L. 271-1 du code de la construction et de l&rsquo;habitation, qui pr\u00e9cise dans quels cas le d\u00e9lai l\u00e9gal de r\u00e9tractation doit \u00eatre respect\u00e9, \u00ab <em>ne concerne que les actes ayant pour objet la construction ou l&rsquo;acquisition d&rsquo;un immeuble \u00e0 usage d&rsquo;habitation<\/em> \u00bb.
