Il para\u00eet donc souhaitable de faire appel \u00e0 un professionnel, pour plus d&rsquo;assurance et pour \u00eatre certain que les diff\u00e9rents \u00e9l\u00e9ments et clauses n\u00e9cessaires y sont bien indiqu\u00e9s dans les r\u00e8gles.<\/p>\n<p>Le document prend le plus souvent la forme d&rsquo;une promesse unilat\u00e9rale de vente ou d&rsquo;un compromis de vente, le plus classique. Ce dernier doit explicitement contenir une clause de r\u00e9tractation pour \u00eatre rompu. Et des d\u00e9dommagements seront probablement demand\u00e9s \u00e0 la partie, vendeur ou acqu\u00e9reur, qui aura rompu l&rsquo;engagement. Cette \u00ab\u00a0promesse synallagmatique\u00a0\u00bb (qui engage les deux parties) est un engagement ferme, donc \u00e9quivalent \u00e0 la vente elle-m\u00eame.<\/p>\n<p>Dans le cadre de <em>la promesse unilat\u00e9rale de vente<\/em>, le vendeur vous fait une offre et vous donne une option sur le logement pendant une dur\u00e9e clairement pr\u00e9cis\u00e9e. Ce cas de figure se rencontre souvent dans le cadre de cession d&rsquo;immeubles aux locataires par des soci\u00e9t\u00e9s. Ce que l&rsquo;on appelle aujourd&rsquo;hui la \u00ab\u00a0vente \u00e0 la d\u00e9coupe\u00a0\u00bb, mais qui n&rsquo;a pas toujours eu si mauvaise r\u00e9putation\u2026<\/p>\n<p>Ensuite, si un avant-contrat d\u00fbment \u00e9tabli a \u00e9t\u00e9 sign\u00e9, l&rsquo;acte d\u00e9finitif et authentique chez le notaire ne fera, grosso modo, qu&rsquo;en reprendre les \u00e9l\u00e9ments et la signature ne reviendra, pour l&rsquo;essentiel, qu&rsquo;\u00e0 un \u00e9change de ch\u00e8ques, une remise de cl\u00e9s, et une prise de date aupr\u00e8s des autorit\u00e9s fiscales !<\/p>\n<p align=\"justify\"><em>Attention<\/em> : L&rsquo;Agence Nationale d&rsquo;Information sur le Logement (ANIL) met en garde contre les risques de la signature d&rsquo;une offre ou d&rsquo;une promesse unilat\u00e9rale d&rsquo;achat. Elle vous engage \u00e0 acheter alors que le vendeur n&rsquo;est pas tenu de vendre.<br \/>Vous pouvez vous retrouver pi\u00e9g\u00e9 le temps que le vendeur se d\u00e9cide \u00e0 donner son accord sur la proposition que vous lui avez faite. Pendant ce temps, il peut tenter de faire monter les ench\u00e8res avec d&rsquo;autres\u2026<\/p>\n<p align=\"justify\"><strong>Les \u00e9l\u00e9ments de l&rsquo;avant-contrat :<\/strong><\/p>\n<p align=\"justify\">\u2022&nbsp;Le prix,<br \/>\u2022&nbsp;Le descriptif d\u00e9taill\u00e9, avec la superficie et \u00e9ventuellement les \u00e9quipements et annexes du logement,<br \/>\u2022&nbsp;La superficie de la partie privative en copropri\u00e9t\u00e9,<br \/>\u2022&nbsp;La condition suspensive relative \u00e0 l&rsquo;obtention du ou des pr\u00eats,<br \/>\u2022&nbsp;Les \u00e9ventuelles servitudes,<br \/>\u2022&nbsp;La situation hypoth\u00e9caire du bien,<br \/>\u2022&nbsp;L&rsquo;existence \u00e9ventuelle d&rsquo;un bail,<br \/>\u2022&nbsp;La date de signature du contrat de vente d\u00e9finitif et de prise de possession du logement,<br \/>\u2022&nbsp;Le montant des honoraires de l&rsquo;interm\u00e9diaire charg\u00e9 de la transaction (l&rsquo;\u00e9ventuel agent immobilier) et \u00e0 qui en incombe les frais (souvent le vendeur qui a pass\u00e9 une annonce\u2026),<br \/>\u2022&nbsp;Les \u00e9l\u00e9ments techniques \u00e9ventuellement n\u00e9cessaires (plomb, amiante, termites, etc.),<br \/>\u2022&nbsp;Un ch\u00e8que de r\u00e9servation,<br \/>\u2022&nbsp;Tout autre \u00e9l\u00e9ment que vous jugerez utile pour avoir une parfaite jouissance du bien.
