Les concubins, lorsqu&rsquo;ils signent l&rsquo;acte d&rsquo;achat de la r\u00e9sidence familiale en indivision, pr\u00e9cisent chacun quelle est la part du logement dont ils sont propri\u00e9taires. Ceci est valable quelles que soient les modalit\u00e9s d&rsquo;acquisition.<\/p>\n<p>N\u00e9anmoins, mieux vaut toujours s&rsquo;approcher au mieux de la r\u00e9alit\u00e9 financi\u00e8re de chacun (apport personnel, participation au remboursement du pr\u00eat) pour \u00e9viter les conflits en cas de s\u00e9paration ou de d\u00e9c\u00e8s de l\u2019un des concubins. Vous pouvez aussi vous retrouver dans le collimateur de l\u2019administration fiscale. Si un concubin n&rsquo;apporte que 10% du prix du logement mais se retrouve propri\u00e9taire de 50%, le fisc pourra consid\u00e9rer qu&rsquo;il s&rsquo;agit d&rsquo;une donation et r\u00e9clamer son d\u00fb.<\/p>\n<p><strong>En cas de s\u00e9paration<\/strong>, si le concubin le plus g\u00e9n\u00e9reux veut r\u00e9cup\u00e9rer son apport, il devra en prouver la r\u00e9alit\u00e9.<br \/>\nSelon le Code Civil stipulant que \u00ab\u00a0nul n&rsquo;est tenu de rester dans l&rsquo;indivision\u00a0\u00bb (article 815), chacun est libre de vouloir reprendre ses parts, donc de vendre le bien \u00e0 tout moment. Cela n&rsquo;est pas le cas dans le cadre du mariage tant que le divorce n\u2019a pas \u00e9t\u00e9 prononc\u00e9. Si vous n\u2019\u00eates pas mari\u00e9 et que votre compagnon d\u00e9c\u00e8de et laisse sa part \u00e0 ses h\u00e9ritiers, ces derniers sont totalement libres d&rsquo;exiger la vente imm\u00e9diate du bien pour obtenir ce qui leur revient de droit. Une protection existe, quoique limit\u00e9e : la convention d&rsquo;indivision, qui emp\u00eachera la vente. Elle doit \u00eatre sign\u00e9e chez un notaire et n&rsquo;est valable que cinq ans. Vous pouvez pr\u00e9voir une clause de rachat au profit du concubin survivant dans l&rsquo;acte notari\u00e9.<\/p>\n<p><strong>Point important :<\/strong> si les concubins ont sign\u00e9 un pacte civil de solidarit\u00e9 avant d&rsquo;acheter le logement, ils sont propri\u00e9taires indivis par moiti\u00e9 du logement, sauf mention contraire ins\u00e9r\u00e9e dans l&rsquo;acte d&rsquo;achat. Et cela m\u00eame si l&rsquo;un des deux prouve qu&rsquo;il a contribu\u00e9 davantage \u00e0 l&rsquo;acquisition. Le concubin survivant signataire d\u2019un PACS peut demander au juge l\u2019attribution pr\u00e9f\u00e9rentielle du logement.<\/p>\n<p>Il existe aussi la solution de <strong>la soci\u00e9t\u00e9 civile immobili\u00e8re<\/strong> (SCI) qui peut s&rsquo;av\u00e9rer bien utile. Au lieu d&rsquo;\u00eatre propri\u00e9taire de parts du logement, les concubins sont d\u00e9tenteurs de parts du capital de la SCI qui est propri\u00e9taire du logement. Le capital \u00e9tant constitu\u00e9 de parts sociales, il est plus facilement partageable. Les h\u00e9ritiers du d\u00e9funt ont \u00e9galement moins de pouvoir que dans le cas de l&rsquo;indivision puisque les d\u00e9cisions sont prises \u00e0 la majorit\u00e9. Reste, puisqu&rsquo;il s&rsquo;agit d&rsquo;une soci\u00e9t\u00e9, les lourdeurs administratives, comptables et fiscales de la SCI.
