Elles peuvent ne pas \u00eatre renouvel\u00e9es et les normes \u00e9voluent. Dans le contrat, il peut \u00eatre stipul\u00e9 que les travaux de remise \u00e0 niveau sont \u00e0 la charge du propri\u00e9taire. \u00bb<\/p>\n<p>Pensez aussi \u00e0 v\u00e9rifier qu&rsquo;une r\u00e9sidence non-m\u00e9dicalis\u00e9e a obtenu l&rsquo;agr\u00e9ment services \u00e0 la personne, qui permet de b\u00e9n\u00e9ficier des avantages fiscaux relatifs \u00e0 l&#8217;emploi d&rsquo;une personne \u00e0 domicile.<\/p>\n<p><strong>Bien choisir sa soci\u00e9t\u00e9 de gestion.<\/strong> Les r\u00e9sidences de services, notamment celles de tourismes, ont d\u00e9fray\u00e9 la chronique avec plusieurs faillites des soci\u00e9t\u00e9s de gestion. Or sans ces soci\u00e9t\u00e9s, les contrats sign\u00e9s deviennent caduques, les loyers n&rsquo;entrent plus et les avantages fiscaux sont remis en cause. \u00ab J&rsquo;ai l&rsquo;impression que les choses ne se passent pas si mal dans les r\u00e9sidences m\u00e9dicalis\u00e9es \u00bb estime Paul Duvaux. \u00ab C&rsquo;est un secteur assez rentable qui demande une expertise. Il existe des barri\u00e8res techniques et juridiques \u00e0 l&rsquo;entr\u00e9e. \u00bb<\/p>\n<p>Ce dernier est un peu plus mesur\u00e9 avec les r\u00e9sidences seniors non-m\u00e9dicalis\u00e9es, qui pour lui, \u00ab s&rsquo;apparentent plus \u00e0 des r\u00e9sidences de tourisme \u00bb. Pour \u00e9viter les tracas, il conseille donc de choisir \u00ab un acteur reconnu et exp\u00e9riment\u00e9 \u00bb du secteur. A titre d&rsquo;exemple : les Senioriales, les Villages d&rsquo;or, Domitys, Quietude&#8230;<\/p>\n<p><strong>Un bail commercial.<\/strong> Lorsque vous signez avec un bail avec la soci\u00e9t\u00e9 de gestion rappelez-vous qu&rsquo;il s&rsquo;agit d&rsquo;un bail commercial. Les dispositions qui s&rsquo;appliquent \u00e0 la signature d&rsquo;un bail civil n&rsquo;ont pas lieu ici. D&rsquo;un dur\u00e9e de neuf ans, le bail commercial est renouvelable tacitement. Or si le propri\u00e9taire souhaite rompre le bail lorsque celui-ci expire, il devra payer des p\u00e9nalit\u00e9s au locataire, ici la soci\u00e9t\u00e9 de gestion. Ces indemnit\u00e9s sont en r\u00e8gle g\u00e9n\u00e9rale \u00e9crites dans le bail. Dans le cadre des r\u00e9sidences non m\u00e9dicalis\u00e9es, il existe cependant des baux qui permettent de r\u00e9cup\u00e9rer le bien pour y habiter.<\/p>\n<p><strong>Une location \u00e0 long terme.<\/strong> Il faut enfin se rappeler que la TVA est enti\u00e8rement remboursable au bout de 20 ans.
