L&rsquo;acc\u00e8s \u00e0 ce r\u00e9gime, destin\u00e9 \u00e0 favoriser la restauration du patrimoine architectural par des propri\u00e9taires priv\u00e9s, vient d&rsquo;\u00eatre facilit\u00e9, un an \u00e0 peine apr\u00e8s avoir \u00e9t\u00e9 restreint. Une disposition a \u00e9t\u00e9 prise en ce sens dans la loi de finances pour 2016, \u00e0 l&rsquo;article 6, sur proposition du s\u00e9nateur PS Vincent Ebl\u00e9.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Agrement_requis_pour_les_coproprietes_revendues_en_lots\"><\/span>Agr\u00e9ment requis pour les copropri\u00e9t\u00e9s revendues en lots<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Le texte autorise \u00e0 nouveau la r\u00e9alisation de programmes de r\u00e9novation en copropri\u00e9t\u00e9, ou via une SCI (soci\u00e9t\u00e9 civile immobili\u00e8re) non soumise \u00e0 l&rsquo;imp\u00f4t sur les soci\u00e9t\u00e9s, de b\u00e2timents inscrits \u00e0 l&rsquo;inventaire suppl\u00e9mentaire des monuments historiques. Chose qui \u00e9tait devenue impossible depuis le 1er janvier 2015.<\/p>\n<p><em>\u00ab Monuments historiques et copropri\u00e9t\u00e9 ne font pas bon m\u00e9nage, il faut obtenir un agr\u00e9ment pour les d\u00e9couper en lots et les commercialiser. En sortant les monuments inscrits du champ de l&rsquo;agr\u00e9ment, la loi fermait quasiment la possibilit\u00e9 d&rsquo;avoir de la copropri\u00e9t\u00e9 en monuments historiques puisque seuls les immeubles class\u00e9s ayant un int\u00e9r\u00eat national \u00e9taient concern\u00e9s <\/em>[ou presque]<em> \u00bb<\/em>, rel\u00e8ve Christine Valence-Sourdille, ing\u00e9nieur patrimonial chez BNP Paribas Banque Priv\u00e9e.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Assouplissement_entre_en_vigueur_au_1er_janvier_2016\"><\/span>Assouplissement entr\u00e9 en vigueur au 1er janvier 2016<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&rsquo;assouplissement est effectif depuis le 1er janvier 2016. Pour les d\u00e9put\u00e9s socialistes Val\u00e9rie Rabault et Fran\u00e7ois Pupponi, la r\u00e9ouverture du dispositif aux immeubles inscrits \u00e0 l&rsquo;inventaire des monuments historiques permet de corriger une incoh\u00e9rence.<\/p>\n<p><!-- \/13306350\/Impots_article_milieu_600x90_b --><\/p>\n<div id=\"div-gpt-ad-1469696330583-0\" style=\"height: 90px; width: 600px; margin: auto;\"><script type=\"text\/javascript\">\/\/ <!&#091;CDATA&#091; googletag.cmd.push(function() { googletag.display('div-gpt-ad-1469696330583-0'); }); \/\/ &#093;&#093;><\/script><\/div>\n<p><em>\u00ab Recentrer le dispositif sur la production de logements, objectif parfaitement l\u00e9gitime, implique de favoriser les projets de r\u00e9novation de grands ensembles, typiquement des anciennes casernes, hospices etc&#8230; en centre-ville de villes moyennes,<\/em> observent les deux parlementaires. <em>Or ces b\u00e2timents sont des b\u00e2timents inscrits, et non class\u00e9s, qui de par leur taille ne peuvent \u00eatre r\u00e9nov\u00e9s que sous un r\u00e9gime de copropri\u00e9t\u00e9, r\u00e9gime qui a pr\u00e9cis\u00e9ment \u00e9t\u00e9 exclu du b\u00e9n\u00e9fice de l&rsquo;agr\u00e9ment par la r\u00e9forme de 2014 \u00bb.<\/em><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Renovation_deductible_des_revenus_sans_plafond\"><\/span>R\u00e9novation d\u00e9ductible des revenus sans plafond<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>La d\u00e9fiscalisation en monuments historiques vise 3 types de b\u00e2timents :<br \/>\n&#8211; les immeubles class\u00e9s, qui rec\u00e8lent un int\u00e9r\u00eat historique et\/ou artistique d&rsquo;ordre national<br \/>\n&#8211; les immeubles inscrits \u00e0 l&rsquo;inventaire suppl\u00e9mentaire, qui ont un int\u00e9r\u00eat plut\u00f4t r\u00e9gional<br \/>\n&#8211; les immeubles ayant obtenu le label de la Fondation du Patrimoine qui permet \u00e0 un b\u00e2timent d&rsquo;\u00eatre \u00e9ligible au r\u00e9gime des monuments historiques sans en \u00eatre ni inscrit, ni class\u00e9 comme tel.<\/p>\n<p>En contrepartie des sommes consacr\u00e9es \u00e0 la r\u00e9novation de son patrimoine historique b\u00e2ti, un propri\u00e9taire non occupant peut b\u00e9n\u00e9ficier d&rsquo;une d\u00e9duction de ces d\u00e9penses sur son revenu global, sans limitation, ce qui permet potentiellement de r\u00e9duire \u00e0 n\u00e9ant ses revenus imposables sur une dur\u00e9e maximum de trois ann\u00e9es fiscales. Le d\u00e9tenteur du bien est alors tenu \u00e0 une obligation de conservation de l&rsquo;immeuble pendant au moins 15 ans \u00e0 compter de sa date d&rsquo;acquisition. Dans le cas particulier d&rsquo;un bien ayant obtenu un agr\u00e9ment pour une r\u00e9novation en copropri\u00e9t\u00e9 ou via une SCI, il doit \u00eatre affect\u00e9 \u00e0 l&rsquo;habitation pour au moins 75% de sa surface habitable.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section>\n","protected":false},"excerpt":{"rendered":"<p>Nouveau revirement pour la d\u00e9fiscalisation en monuments historiques.
