Le legs peut en effet \u00eatre r\u00e9voqu\u00e9 si le logement est vendu avant le d\u00e9c\u00e8s de son propri\u00e9taire et la d\u00e9livrance de la succession, comme le rappelle la Cour d&rsquo;appel de Paris dans un arr\u00eat rendu le 26 novembre 2014. Cette jurisprudence s&rsquo;appuie sur l&rsquo;article 1038 du code civil, selon lequel \u00ab <em>toute ali\u00e9nation, celle m\u00eame par vente avec facult\u00e9 de rachat ou par \u00e9change, que fera le testateur de tout ou de partie de la chose l\u00e9gu\u00e9e, emportera la r\u00e9vocation du legs pour tout ce qui a \u00e9t\u00e9 ali\u00e9n\u00e9<\/em> \u00bb.<\/p>\n<p>Dans l&rsquo;affaire jug\u00e9e, le propri\u00e9taire du bien avait sign\u00e9 une promesse de vente un mois avant son d\u00e9c\u00e8s. Son testament ne comportait pas d&rsquo;indication expresse \u00e0 ce sujet permettant d&rsquo;\u00e9carter la r\u00e9vocation du legs. De m\u00eame, la promesse de vente n&rsquo;\u00e9tait pas conditionn\u00e9e de telle sorte que la cession soit annul\u00e9e en cas de d\u00e9c\u00e8s du vendeur avant la signature de l&rsquo;acte authentique d&rsquo;achat. D\u00e8s lors, l&rsquo;article 1038 du code civil ne peut pas \u00eatre remis en cause et le bien immobilier ne peut plus figurer dans le legs.<\/p>\n<p>Autre consid\u00e9ration port\u00e9e par cet arr\u00eat, tout ou partie du prix de vente ne peut pas \u00eatre transmis au b\u00e9n\u00e9ficiaire originel de la succession de l&rsquo;actif immobilier en l&rsquo;absence d&rsquo;indication expresse. Dans le testament consid\u00e9r\u00e9, le d\u00e9funt \u00e9voquait la transmission de sa part de l&rsquo;immeuble \u00e0 sa fille. La Cour d&rsquo;appel de Paris a estim\u00e9 que cette formulation n&rsquo;impliquait pas express\u00e9ment la transmission de la part du prix de vente correspondante mais faisait r\u00e9f\u00e9rence au fait que le d\u00e9funt d\u00e9tenait seulement une partie de l&rsquo;actif.<\/p>\n<table style=\"background-color: #e0e0dd; width: 100%; border: #b0b0b0 thin solid;\" border=\"0\" cellpadding=\"5\">\n<tbody>\n<tr>\n<td>\n<h2 style=\"text-align: center;\">Donation : r\u00e9vocation possible en cas d\u2019interdiction de vente<\/h2>\n<p>La r\u00e9vocation d\u2019un legs immobilier est \u00e9galement possible lorsqu\u2019une donation comporte une interdiction de vendre le bien. La Cour d\u2019appel de Paris avait rendu un arr\u00eat \u00e0 ce titre le 14 octobre 2009. Le don d\u2019un p\u00e8re \u00e0 sa fille comportait une interdiction de cession du bien du vivant du donateur. La fille avait contrevenu aux termes de la donation, en l\u00e9guant l\u2019usufruit, c\u2019est-\u00e0-dire la jouissance du bien, \u00e0 son concubin sans l\u2019approbation de son p\u00e8re. Le p\u00e8re avait alors obtenu la r\u00e9vocation de la donation de cet actif immobilier. La Cour d\u2019appel de Paris avait \u00e9galement engag\u00e9 la responsabilit\u00e9 du notaire qui n\u2019avait pas fait appliquer la clause
