Si l&rsquo;achat d&rsquo;un bien en direct entre dans la base taxable \u00e0 l&rsquo;imp\u00f4t de solidarit\u00e9 sur la fortune, ce n&rsquo;est pas le cas de l&rsquo;acquisition de la seule nue-propri\u00e9t\u00e9. Une strat\u00e9gie de d\u00e9membrement de propri\u00e9t\u00e9 qui trouve notamment son int\u00e9r\u00eat via le dispositif d&rsquo;usufruit locatif social (ULS).<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Le_principe\"><\/span>\u2022 Le principe<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>L&rsquo;ULS repose sur le principe du d\u00e9membrement de propri\u00e9t\u00e9, consacr\u00e9 par les articles 578 et suivants du Code civil et compl\u00e9t\u00e9 par une s\u00e9rie de dispositions l\u00e9gislatives prises de 2003 \u00e0 2009. Ainsi, la s\u00e9paration, temporaire, de la nue-propri\u00e9t\u00e9 (d\u00e9tention du bien) et de l&rsquo;usufruit (jouissance du bien) permet d&rsquo;acqu\u00e9rir un immeuble, souvent neuf, \u00e0 moindre co\u00fbt avec une perspective de forte plus-value \u00e0 l&rsquo;issue de la reconstitution de la pleine propri\u00e9t\u00e9 (ou remembrement). Il faut compter le plus souvent sur une d\u00e9cote de 40% sur une dur\u00e9e de d\u00e9membrement de 15 ans. Celle-ci est la contrepartie de l&rsquo;absence de perception de loyers durant toute la dur\u00e9e de l&rsquo;usufruit.<\/p>\n<p>Durant le d\u00e9membrement, le bien est confi\u00e9 \u00e0 un bailleur social. Ce dernier per\u00e7oit les loyers, se charge de la gestion locative et s&rsquo;assure de l&rsquo;entretien de l&rsquo;immeuble. A l&rsquo;issue du d\u00e9membrement, l&rsquo;investisseur devient plein propri\u00e9taire. Entre temps, \u00ab <em>l&rsquo;actif se valorise m\u00e9caniquement<\/em> \u00bb, explique G\u00e9raldine Tyl Chaigne, directrice commerciale du sp\u00e9cialiste du secteur Perl.<\/p>\n<p style=\"background-color: #e5e5e5;\"><strong>Exemple :<\/strong> Un immeuble de valeur 100 est acquis au prix de 60 avec un d\u00e9membrement de 15 ans. La seule reconstitution de la pleine propri\u00e9t\u00e9 durant cette p\u00e9riode \u00ab <em>sert, sur 15 ans, un rendement de 3,46% par an net de fiscalit\u00e9 \u00e0 l&rsquo;investisseur<\/em> \u00bb. Et ce sans prendre en compte une potentielle \u00e9volution du march\u00e9 immobilier.<\/p>\n<p>Les biens propos\u00e9s en ULS sont g\u00e9n\u00e9ralement situ\u00e9s dans des quartiers ou des communes plut\u00f4t hupp\u00e9s. Les bailleurs sociaux y logent des actifs (salari\u00e9s ou fonctionnaires) jeunes, \u00ab<em> qui n&rsquo;ont pas vocation \u00e0 rester de mani\u00e8re p\u00e9renne dans les lieu<\/em>x \u00bb.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Quelle_consequence_sur_lISF\"><\/span>\u2022 Quelle cons\u00e9quence sur l&rsquo;ISF ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Selon le droit fiscal en vigueur, c&rsquo;est l&rsquo;usufruitier qui est tenu de d\u00e9clarer le bien en pleine propri\u00e9t\u00e9. La nue-propri\u00e9t\u00e9 n&rsquo;entre pas dans la base taxable \u00e0 l&rsquo;imp\u00f4t de solidarit\u00e9 sur la fortune. Autrement dit, le nu-propri\u00e9taire d\u00e9tient un patrimoine immobilier de premier choix sans en payer le prix fiscal.<\/p>\n<p>En contrepartie, le nu-propri\u00e9taire ne per\u00e7oit pas de revenus locatifs, ce qui a le m\u00e9rite de ne pas alourdir sa charge fiscale au titre de <a href=\"https:\/\/www.toutsurmesfinances.com\/impots\/comment-declarer-les-revenus-fonciers-tires-d-une-location-non-meublee.html\" target=\"_blank\"><strong>l&rsquo;imposition des revenus fonciers<\/strong><\/a>. Il doit attendre la fin du d\u00e9membrement pour devenir seul ma\u00eetre \u00e0 bord de son investissement.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Comment_lULS_permet-il_de_reduire_son_ISF\"><\/span>\u2022 Comment l&rsquo;ULS permet-il de r\u00e9duire son ISF ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>En tant que tel, le d\u00e9membrement de propri\u00e9t\u00e9 proprement dit ne diminue pas l&rsquo;ISF : il \u00e9vite simplement de l&rsquo;alourdir.<\/p>\n<p>Mais certains investisseurs peuvent r\u00e9duire la note via l&rsquo;usufruit locatif social. La cl\u00e9 : ne pas investir \u00e0 cr\u00e9dit. \u00ab <em>Nous avons un profil de clients qui investissent directement en fonds propres<\/em>, d\u00e9veloppe G\u00e9raldine Tyl Chaigne. <em>Pour eux, non seulement le bien est exon\u00e9r\u00e9 d&rsquo;ISF mais ils en diminuent la base taxable \u00e0 hauteur du montant investi.<\/em> \u00bb<\/p>\n<p>En d&rsquo;autres termes, l&rsquo;argent sort des comptes bancaires, soumis \u00e0 l&rsquo;imp\u00f4t sur la fortune, pour financer l&rsquo;achat d&rsquo;un patrimoine exon\u00e9r\u00e9 d&rsquo;ISF.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%A2_Et_si_jinvestis_a_credit\"><\/span>\u2022 Et si j&rsquo;investis \u00e0 cr\u00e9dit ?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Que les choses soient claires : financer un investissement en ULS \u00e0 cr\u00e9dit, et <a href=\"https:\/\/credits.toutsurmesfinances.com\/credit-immobilier-des-taux-records-et-des-economies-consequentes.html\" target=\"_blank\"><strong>profiter des taux au plus bas<\/strong><\/a>, s&rsquo;av\u00e8re tout \u00e0 fait possible. Et ce, sans rench\u00e9rir la charge fiscale.<\/p>\n<p>Mais si un financement bancaire s&rsquo;av\u00e8re indispensable, l&rsquo;investisseur ne peut pas r\u00e9duire son ISF en d\u00e9duisant de son patrimoine l&#8217;emprunt souscrit \u00e0 cet effet. Depuis 2013, la loi ne permet plus d&rsquo;inscrire au passif les dettes contract\u00e9es pour l&rsquo;acquisition de biens exon\u00e9r\u00e9s d&rsquo;ISF. Un principe fix\u00e9 \u00e0 l&rsquo;article 885 G quater du code g\u00e9n\u00e9ral des imp\u00f4ts.<\/p>\n<p>En revanche, <a href=\"https:\/\/www.toutsurmesfinances.com\/impots\/comment-le-credit-immobilier-permet-de-reduire-ses-impots.html\" target=\"_blank\"><strong>les int\u00e9r\u00eats du pr\u00eat restent d\u00e9ductibles des revenus fonciers<\/strong><\/a> per\u00e7us par ailleurs.
